Its hard for me to get a good pic of him. Especially since I am taking these with the camera on my cell phone. But here is one that is a little clearer. Does your snake look like this?

I have been told that he is a Thamnophis sirtalis sirtalis (Eastern Garter Snake)

then that's probably right
there are very few species I can reliably identify
