    They are dinural, and from my experience they prefere to be out late morning. Google pictures of venomous snakes, they look very different then garters. As Steve said, it sounds like you don't really know anything about them. Study them some before you do anything.

    You mean you want to catch them then release them somewhere else? There's really no reason to remove them from your garden... They're completely harmless. Also, they're in your yard because there's something there that they like. You can catch and remove some, but you'll just find more. I'd recommend just leaving them alone.
    What state are you in? It should be pretty easy to tell the difference between a garter and anything venomous.
