I've heard that it is illeagal to own a garter snake in BC and Alberta for some reason. does anyone know the truth to this? I've been told to check my bylaws.:confused:

no its not illegal to posses a garter some are legal to own and sell like oragon spotteds, checkereds and a few other. however all the wild ones you find chances are are eather a plans garter or wandering garter and they are legal to posses but illegal to trafic(sell,trade,give) i have a few garters myself :) ill attach a copy of licence and non licence animals and break it down for you a bit

135(1) Subject to subsection (2), a person may possess any live non‑licence animal except a raccoon, a skunk or a bat of a kind that is a wildlife animal.

However you can't Export or Traffic them apparently.

Non-licence animals - ss59(1) and 62(1) and (2)

22 Non‑licence animals that are lawfully killed or that are possessed live in accordance with section 135 of this Regulation, other than

(a) plains garter snake,

(b) wandering garter snake,

(c) red‑sided garter snake, and

(d) bull snake,

are exempt from the application of sections 59(1) and 62(1) and (2) of the Act.

Sections 59 and 62 from the Alberta Wildlife Act:

Exportation of wildlife

59(1) A person shall not export wildlife from Alberta unless the person is so authorized by a permit specifically authorizing the exportation.

(2) A person shall not issue a permit authorizing the exportation of a domestic cervid unless the person is satisfied that the animal is being shipped by the owner of the animal or that owner?s agent.

Trafficking in wildlife

62(1) A person shall not traffic in wildlife.

(2) A person shall not be in possession of wildlife for the purpose of trafficking in wildlife.

(3) Subsections (1) and (2) do not

(a) apply if and to the extent that the trafficking or the possession is specifically authorized by a permit or is authorized by or under the Livestock Industry Diversification Act,

(b) apply if the trafficking or possession is reasonably incidental to the operation of a fur farm in accordance with the Fur Farms Act or is in accordance with the Meat Inspection Act or the Meat Inspection Act (Canada), or

(c) prevent a person from acquiring wildlife from the Minister under section 9.

(4) Each single act described in section 1(1)(gg)(i) or (ii) done in relation to a wildlife animal constitutes a separate act of trafficking in wildlife.

BC you will find very pretty Northwesterns (T.ordinoides) I believe it us illegal to collect from the wild or possess a native species.

There ya go, reddeerexotics pretty well covered it. The native Alberta species you can keep (Red Sided, Plains & Wanderings) but not buy/sell/trade import or export. That includes any "morphs" & doesn't matter if they're WC or captive bred elsewhere, you need a special permit that are essentially only issued to Zoo's & research facilities. Hobbyists & breeders will not get these licences. Pretty much anything else Thamnophis we can keep & buy/sell trade etc in Alberta though (except Butler's Garters and Eastern Ribbon snakes). Just to clarify the Alberta act, "Non-License" and "Non-Game" refers to native wildlife species while the "Controlled" section refers to non-native species. More discussion on the Alberta regulations is in the thread above that kimbosaur linked to.

BC on the other hand you cannot keep/collect anything Thamnophis period without a permit which they also state outright the likelihood of getting as "very low". For anyone doubting the BC regulations here is a copy of the email I received last July from the BC government asking for interpretation of their regulations. I was hoping that their regulations were referencing only native Thamnophis species, but you can see it's unfortunately all Thamnophis:

"Hello Mr. Stinson,

Thank you for your email regarding Thamnophis sp. and the Wildlife Act. All species of the genus Thamnophis are considered wildlife (NOT Controlled Alien Species). However, a person who wants to possess any Thamnophis species (both dead or alive) would still need to have a permit from the Fish, Wildlife and Habitat Management Branch.

Please visit the Permit and Authorization Service Bureau at http://www.env.gov.bc.ca/pasb/applicati ... dlife.html (http://www.env.gov.bc.ca/pasb/applications/process/wildlife.html) for more information on applying for permits to possess wildlife in BC. I should also mention that there is a very low likelihood of receiving a permit to possess wildlife as a pet in BC.

Unfortunately these links won't do you much good in this case. The Wildlife Acts are dealt with on a provincial level not a federal level. Federally it deals with protecting native endangered species. Each Province has their own Wildlife Act, and communities will also have their own bylaws that may or may not further prohibit keeping within city limits. If you're in Edmonton I'm not aware of anything specifically dealing with garters but I would recommend checking with the city if you have concerns.
